Disputes and Legal Jurisdiction

In the event of any dispute arising from your use of AYS Digital services, jurisdiction will lie with the High Court. All disputes shall be resolved in accordance with English law.

Call Recording

AYS Digital reserves the right to record certain telephone conversations for legal and training purposes. These recordings will never be shared with any third party unless a valid, written warrant is provided by a court of law.

No Agency or Partnership Relationship

You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and AYS Digital as a result of using our services. You agree not to present yourself as a representative, agent, or employee of AYS Digital. We are not liable for any representations, actions, or omissions made by you.

Domain Disputes

In the event of a dispute over domain ownership or registration, the relevant domain Registry (e.g., Nominet, InterNIC) will manage communication and resolution between affected parties, as per their individual terms. AYS Digital is not responsible for arbitrating such disputes and will only forward relevant communications from the Registry to the client.

Intellectual Property Rights

All content (text and images) provided by the client remains the copyright of the client. All content, website designs, and software created by AYS Digital remain the exclusive intellectual property of AYS Digital. Boilerplate or placeholder content used when a client does not provide material may appear on other websites and may negatively impact SEO performance. AYS Digital reserves the right to place our own or a third-party banner or footer credit on any website we produce. We reserve the right to reuse design elements or entire layouts from current or former clients in future projects.

Hosting & Cancellation Policy

If a customer cancels their subscription or requests a transfer away from AYS Digital, all content owned by the client will be preserved. However, the website itself will be taken offline and no longer be accessible.

Refunds are not guaranteed and are granted at the sole discretion of AYS Digital. No refunds will be issued:
– After 14 calendar days from the original payment date, or
– If any work has already been carried out (e.g., hosting setup, email correspondence, technical configuration).

Attempts to claim ownership over AYS Digital’s original design work, coding, or structure will be considered a breach of intellectual property rights and may result in legal action.

GDPR Compliance

AYS Digital collects and securely stores customer data, which may include:
– Business names
– Addresses
– Contact details
– Payment information
– Website-related content (including images and text)

This data is retained for up to 5 years from the last use and is then securely deleted.

Changes to Terms
